1. Introduction and Acceptance of Terms
1.1 Purpose of this section
At VibeQueue, we want to ensure you understand exactly what to expect from us, and what we expect from you as a user of our platform. This section clearly and thoroughly explains the nature of our platform, the services we offer, who can use them, and the core rules of use. This document forms a legal contract between you (the user) and VibeQueue. Therefore, we invite you to read it carefully.
1.2 What is VibeQueue
VibeQueue is an interactive platform designed to enhance the musical experience at social events and parties. It allows attendees to discover the event's music, vote for their favorite songs, and propose new songs through one-time payments. These payments are not charged automatically but are held until the DJ confirms that the song has been played. If the song is not accepted or not played, the amount is released at no cost.
DJs and event managers use VibeQueue as a control tool to manage song requests, validate payments, and decide what gets played. All of this happens in real time, with a focus on transparency, interaction, and respect for the event experience.
1.3 Services we offer
- Web interface and mobile app for attendees, DJs, and organizers.
- Real-time song search and suggestion system.
- Option to make voluntary payments for musical requests.
- Voting mechanism to prioritize popular songs.
- Event management with tools for DJs (accept, reject, mark as played).
- Activity logging and song history.
- Event settings, minimum pricing, and collaborator roles.
It is important to note that VibeQueue is not a music content provider or audio streaming platform, but a tool to facilitate live interaction between attendees and DJs during events.
1.4 Who can use VibeQueue
The platform is intended for adults (18 years and older) who attend events compatible with our system or who participate as organizers/DJs. If you are a DJ, promoter, or venue, you must create a user account to manage your events, access configuration tools, and receive payments through our secure payment gateway integrated with Stripe.
Event attendees can access without registration by scanning a QR code or entering the provided event code. In that case, they get a limited view to search for songs, vote, and make one-time payments.
2. User Obligations
By using VibeQueue, whether as an attendee, DJ, collaborator, or administrator, you agree to respect certain conduct rules and use the platform ethically, responsibly, and in accordance with applicable laws. The following conditions detail your commitments to us and other users.
2.1 Accuracy of provided information
Users are responsible for ensuring that all information entered into the platform is truthful, accurate, and up to date. This includes, but is not limited to, contact details, registration information, and any content submitted through the system.
DJs or event administrators must provide a valid email, username, and if they want to receive payments, a connected Stripe payment account. Any falsehood, omission, or fraudulent use of data may result in temporary or permanent suspension of the account.
2.2 Responsible use of the platform
- No unauthorized access attempts to restricted areas.
- No use of automated software/scripts that interfere with normal service use.
- No manipulation of event order or logic through external technical means.
- No simulated interactions or unnecessary server loads.
VibeQueue reserves the right to temporarily or permanently block any user who violates this policy.
2.3 Use of payments and song requests
- Requests will be evaluated by the DJ or event administrator.
- Payments are held, not charged immediately.
- Only charged if the song is accepted and marked as played.
- If rejected or not played, the amount is released without additional charges.
Offensive messages, blackmail, inappropriate language, or misuse of the request feature for non-musical purposes is strictly prohibited.
2.4 Respectful behavior
- No discrimination based on race, gender, religion, sexual orientation, age, or origin.
- No offensive, explicit, violent, or hateful content.
- No verbal abuse through song names or other means.
- No practices harming the public image of events or professionals involved.
VibeQueue may intervene, moderate, or remove content/accounts that violate these rules.
3. Responsibilities of VibeQueue
3.1 Service Provision
VibeQueue is committed to providing stable, secure, and continuous access to the platform, except in cases of technical interruptions, maintenance tasks, updates, or force majeure events.
While we make continuous efforts to improve the performance and availability of the platform, VibeQueue does not guarantee that the service will be error-free or operate uninterruptedly across all devices or internet connections.
In the event of a prolonged service interruption, we will notify affected users to the best of our ability and work toward a prompt resolution.
In the case of lost access, users can request password recovery through the dedicated “Forgot Password” feature available in the login interface.
3.2 Payment Integrity
VibeQueue handles payment operations through Stripe, a third-party provider specialised in electronic payments. The platform never directly accesses or stores the user’s banking information.
Our responsibility is limited to facilitating the connection between the user and the payment processor, as well as managing the logical flow of the song payment process, including:
- Temporary holding of the payment amount.
- Releasing the amount if the playback condition is not met.
- Charging the user only if the song is marked as played.
We assume no responsibility for errors attributable to the payment provider, technical failures from banks, or misuse by the user.
3.3 Content Verification
While user-generated content (like song or event names) is not pre-moderated, VibeQueue reserves the right to review and remove any content violating these terms, applicable laws, or flagged by users as inappropriate.
3.4 Limitation of Liability
VibeQueue shall not be held liable for direct or indirect damages, loss of profits, missed opportunities, business interruptions, or data loss resulting from the use or inability to use the platform, even when such damages are foreseeable.
In particular, we are not responsible for:
- The fulfilment of musical requests by the DJ.
- The decision to accept or reject song requests.
- The behaviour of attendees or administrators in the physical environment of the event.
- Disputes between users regarding playbacks, payments, or collaborations.
3.5 Dispute Mediation
In the event of a dispute related to a song request payment, VibeQueue will act as a neutral mediator. Technical logs and any user-provided evidence will be reviewed. VibeQueue will make a final decision based on the facts, which both parties agree to abide by.
Our intervention does not replace judicial procedures if either party wishes to escalate the conflict outside the platform.
4. Platform Access and Usage Conditions
4.1 Age Requirements
Access to VibeQueue is strictly limited to individuals aged 18 and older. By registering or using the platform, users expressly declare they are of legal age and are solely responsible for the truthfulness of this declaration. VibeQueue reserves the right to block or remove accounts suspected of being operated by minors without prior notice.
4.2 Access Without an Account
Event attendees do not need to register or create an account to request songs or access public event information. Access is granted through an event code, which directly connects the user to the event's public interface. However, DJs and organizers must create an account to manage events, access analytics, and use advanced configuration tools.
4.3 Accuracy of Provided Information
Users agree to provide accurate, complete, and up-to-date information during registration and throughout their use of the platform. Any falsification may result in the suspension or termination of the user account without compensation. Users are also responsible for maintaining the confidentiality of their login credentials and any activity under their account.
4.4 Proper Use of the Platform
VibeQueue must not be used for illegal, fraudulent, or disruptive activities. Prohibited behaviors include:
- Publishing obscene, defamatory, or violent content
- Manipulating the voting or payment system
- Creating misleading event pages or codes
- Using bots or unauthorized software to interact with the platform
VibeQueue reserves the right to delete content or accounts violating these rules and to pursue legal action in cases of criminal activity.
4.5 Service Updates
To improve the user experience, VibeQueue may introduce updates that change navigation flow, technical compatibility, or these terms of use. These changes can occur without prior notice. Users are encouraged to periodically review the latest version of the Terms and Conditions to stay informed.
5. Payment Conditions and Methods
5.1 Song Request Payment
VibeQueue does not operate on a subscription or recurring billing model. The platform is free for DJs and attendees. The only monetary transaction occurs when a user voluntarily attaches a payment to a song request during an active event. This payment boosts the visibility of the request and gives DJs the option to prioritize it.
5.2 Payment Flow
The payment process is designed to protect both the user and the DJ. The sequence is as follows:
- The user selects a song via the integrated search tool.
- They choose how much to pay (above the event's minimum if defined).
- The amount is held from their account but not charged immediately.
- If the DJ marks the song as "played," the payment is captured.
- If the song is rejected or not played, the hold is released without any charge.
This process ensures fair transactions and prevents misuse of the request system.
When a payment is made through Stripe, we collect and store limited transaction data necessary for processing and compliance purposes, including the payer’s name, email address, amount paid, and date of the transaction.
5.3 Accepted Payment Methods
Through integration with Stripe®, users can securely pay using:
- Credit or debit cards
- Apple Pay
- Google Pay
- Twint (available in Switzerland)
All payments are processed directly by Stripe, and VibeQueue never stores sensitive financial data.
5.4 Organizer-Selected Currency
Each event can be configured with a default currency chosen by the DJ or event admin. All payments are processed in this currency and displayed to users before submitting a request. Stripe handles automatic currency conversion and any applicable fees.
5.5 Receipts and Confirmation
After a successful charge, users receive a receipt via their payment provider (e.g., bank, Apple Wallet). Additionally, VibeQueue displays a confirmation on-screen after the process completes.
6. Refund Policy and Dispute Management
6.1 Claim Process
Since final users (attendees requesting songs) do not create an account on the app, refund claims are handled through Stripe's official dispute system. Once our Terms and Conditions are activated on Stripe, buyers can request a refund directly from their payment confirmation email or through their bank's customer support.
The maximum period to file a claim is 24 hours after the event ends. After this window, funds may be released to the DJ, and new claims will no longer be accepted.
Users may cancel their song request using the cancellation link in the confirmation email, as long as the song has not been played. Once the playback has started or the request is marked as “played,” cancellation is no longer possible, and users must contact support for further assistance.
6.2 Review and Refund
Upon receiving a claim, Stripe initiates a dispute resolution process. Simultaneously, the VibeQueue team is notified and may submit relevant evidence, such as:
- Audio recordings uploaded by the DJ.
- Internal data showing whether the song was marked as played.
- Technical logs from the event session.
If the DJ fails to provide proof that the song was played (e.g., missing audio evidence), Stripe will issue a refund to the customer. If the DJ provides solid evidence, the dispute may be denied.
6.3 Fund Hold Period
To ensure fair handling, funds are not instantly released to the DJ after the event:
- A 24-hour hold period follows the event's conclusion.
- During this time, users can initiate a dispute if needed.
- If no dispute is filed, the funds become available for withdrawal through Stripe.
6.4 Support and Resolution
For further assistance or inquiries regarding disputes, users can contact us at support@vibequeue.com. If a Stripe claim has already been initiated, the resolution will follow Stripe's official process, and our team will cooperate as needed.
Song requests can be cancelled by the user via the cancellation link provided in the confirmation email, as long as the song has not yet been played. If the song has already been played or the payment has been processed, users must contact us at support@vibequeue.com for further assistance.
All support requests must include the payment confirmation ID and the event code to be considered valid. We reserve the right to disregard incomplete or unverifiable refund claims.
7. Platform Use Rules and Responsibilities
7.1 Proper Use of the Application
Users must use the application legitimately, respectfully, and in accordance with applicable laws. It is strictly forbidden to:
- Use the platform for fraudulent, illegal, or harmful purposes.
- Impersonate another person or entity.
- Intentionally manipulate prices, payments, or platform functionality.
- Make malicious or irrelevant song requests.
- Use unauthorized automated tools or scripts to interact with the system.
7.2 Requester Responsibilities
When submitting a song request, the user must:
- Ensure the accuracy of entered information.
- Acknowledge that the DJ or event admin may accept or reject the request.
- Understand that the payment is only processed if the DJ marks the song as played.
- Initiate any refund claims within 24 hours after the event ends (see Section 6).
7.3 DJ or Event Admin Responsibilities
DJs and event admins must:
- Fulfill accepted requests honestly and transparently.
- Only mark songs as "played" if they were actually played at the event.
- Use the audio recording feature to retain proof in case of disputes.
- Refrain from playing offensive or illegal songs.
Misuse of the system, dishonest handling of requests, or repeated abuse may result in account suspension.
7.4 User Accounts and Access
While attendees do not need accounts to submit song requests, DJs and event organizers must register. They are responsible for:
- Keeping their login credentials confidential.
- Avoiding unauthorized account sharing.
- Reporting any suspicious activity to our support team.
7.5 Limitation of Responsibility
VibeQueue acts solely as a technology intermediary between requesters and event organizers. We are not responsible for:
- Technical failures related to user devices or networks.
- Cancelled or altered events.
- DJ decisions to reject song requests.
8. Economic Conditions and Payment Methods
8.1 Payment Per Song Request
Attendees can suggest songs during events by attaching a monetary value to their request. The amount is freely determined by the user, but must meet or exceed the event organizer's defined minimum.
8.2 Hold and Charge Mechanism
The payment system follows this process:
- The user selects a song using the integrated search tool.
- They specify how much they want to pay, meeting the event minimum.
- The selected amount is placed on temporary hold (no immediate charge).
- If the DJ confirms the song was played, the amount is charged automatically.
- If rejected or unplayed, the hold is released with no cost to the user.
This protects users from unnecessary charges and ensures DJs only earn from fulfilled requests.
8.3 Accepted Payment Methods
VibeQueue integrates with Stripe® to securely process payments. Supported methods include:
- Credit or debit cards
- Apple Pay
- Google Pay
- TWINT (in supported countries)
Stripe ensures international security compliance, and VibeQueue does not store any sensitive financial data.
8.4 Currency Defined by Organizer
Each event can be configured to use a specific currency chosen by the DJ or administrator. All payment displays and transactions for that event will be conducted in that currency.
Stripe handles any necessary currency conversion, applying exchange rates and fees based on the user's bank or wallet.
8.5 Payment Confirmation
Once the payment is successfully processed, users will be able to confirm that their request was received through multiple channels. Firstly, a notification will appear in the Request Queue, indicating that the song request has been registered and is awaiting action from the DJ. Secondly, users will receive a confirmation message from their payment provider (e.g., their bank or Apple Wallet) stating that the payment amount has been retained—but not yet charged.
The payment will only be captured once the DJ confirms that the requested song was played during the event. Until then, the funds remain on hold, and no final charge is executed. This dual-layer confirmation system ensures that users stay informed throughout the process while maintaining transparency around pending and completed payments.
9. Governing Law and Jurisdiction
9.1 Applicable Law
These Terms and Conditions shall be governed and interpreted in accordance with the laws of Switzerland, without regard to its conflict of law principles.
9.2 Jurisdiction
Any dispute, claim, or controversy related to the use of VibeQueue services shall be subject to the exclusive jurisdiction of the ordinary courts of Zurich, Switzerland.
9.3 Prior Amicable Resolution
Before taking legal action, VibeQueue encourages users to seek an amicable resolution by contacting our support team at support@vibequeue.com. If a formal complaint has been submitted through Stripe's dispute system, resolution will proceed following their standard process, with our cooperation as necessary.
